A dismissed cadet has filed a lawsuit against the Ministry of Internal Affairs Academy.

A Kazakh student who was expelled from her first year has had her lawsuit to declare her contract with the Kostanay Academy of the Ministry of Internal Affairs invalid rejected, according to NUR.KZ, citing the regional court.

According to the official Telegram channel of the court, a civil case regarding a lawsuit from a Kazakhstani citizen against the Kostanay Academy of the Ministry of Internal Affairs, seeking to declare part of the contract invalid, was heard in the Kostanay City Court.

The case materials indicate that the parties entered into a contract under which the educational organization committed to train the cadet.

According to an excerpt from the personnel order, the plaintiff was expelled from the first-year cadets and dismissed from the internal affairs bodies of the Republic of Kazakhstan at her own request.

Upon her expulsion, the Kazakhstani citizen was provided with a certificate of the training expenses incurred by the state and a notification regarding the voluntary payment of these expenses.

"During the court session, the young woman explained that there was no information regarding the amount spent on her training at the time of the contract's conclusion and termination. The defendant concealed the actual amount for training and the maintenance of the cadet from the plaintiff when the contract was signed," the court reported.

The court established that, according to the contract, the trainee is obligated to serve in the internal affairs bodies for at least five years. In the event of voluntary expulsion or refusal to serve, the cadet is responsible for reimbursing the funds spent on their training.

In accordance with current legislation, the cost of training at the Academy is calculated annually by the order of the Minister of Science and Higher Education. The contract specifies the obligations of the cadet, including reimbursement of budget funds spent on training, payment of scholarships, meals, clothing allowances during the training period, and travel expenses to and from the place of study during vacation periods.

The court concluded that the Academy adhered to the form and content of the contract, which the young woman acknowledged by signing each page of the contract.

As a result, the court decided to fully deny the lawsuit of the Kazakhstani citizen against the RGU "Kostanay Academy of the Ministry of Internal Affairs." The court's decision has not yet entered into legal force.

According to information on the official website, the Kostanay Academy named after Sh. Kabylbaev of the Ministry of Internal Affairs of the Republic of Kazakhstan is the only higher educational institution in the country that trains specialists for the criminal-executive system. Students are provided with free education, accommodation, meals, medical care, and uniforms.

A previously dismissed employee filed a lawsuit against the Emergency Situations Academy in Kokshetau—she had worked as the head of the medical department. She was reinstated at work and received back pay from the employer, as her disciplinary action for misconduct was carried out in violation of the law.
