A resident of Pavlodar purchased a car for 19 million tenge and later managed to get a refund for his money.

A resident of Pavlodar successfully reclaimed over 19 million tenge for a defective car through the courts. He sought assistance from the Department of Consumer Rights Protection, as reported by Pavlodarnews.kz.

The man purchased the car in December 2023 for 19,190,000 tenge. He immediately arranged for insurance. During the first maintenance, the oil and filters were replaced.

"After that, the man and his family left for Ekibastuz, and during the journey, he noticed that a warning light on the dashboard indicated a low oil level, and the engine began to make unusual noises. The next day, he discovered that there was no oil in the engine. On the same day, he called the call center. It was only after multiple inquiries and phone calls that a service team was sent to him, arriving by noon. Upon inspection, it was found that the oil had leaked through the oil filter,” the press service of the consumer rights protection department reported.

From March 13 to April 12, 2024, the vehicle was in the service center. The engine was opened, and the owner was not provided with any written documentation.

According to the agency, if a consumer identifies a significant defect in a technically complex product and requests its replacement, the seller (manufacturer, contractor) of the technically complex product and its components is obliged to fulfill this request within 30 working days.

Employees of the consumer rights protection department assisted the man in drafting a pre-trial complaint, after which he filed a lawsuit to terminate the vehicle purchase agreement and demand a refund.

"The court ruled to compensate the consumer: the paid amount of 19,190,000 tenge, a penalty of 959,500 tenge, damages of 62,810 tenge, as well as moral damages of 100,000 tenge and court costs of 203,969 tenge, totaling 20,516,279 tenge,” the department's press service informed.

It was previously reported that a resident of Astana managed to return a defective vehicle and recover the expenses from the dealership. An expert examination revealed defects, presumably caused by a manufacturing flaw, which made the vehicle impossible to operate.

In the ZKO region, compensation for moral damages and penalties was recovered from the dealership in favor of the buyer due to subsequent improper repairs of the car. The man received more than 2.3 million tenge.

A resident of Almaty, facing a serious breakdown of a new vehicle caused by a defect in the high-voltage battery, defended his rights in court and recovered 48 million tenge.
